Terms of Use
Version 8 · October 19, 2026
These terms are the agreement between you and We Sync Global, LLC for using
the Smart Fams app (today at app.smartfams.com, and the coming
iPhone app) and this website, smartfams.com. They are deliberately written in
plain language, but they are a contract: if anything is unclear, ask us before you accept them.
The short version
- Smart Fams is a tool for organizing and playing as a family. It is not a medical, psychological, educational, nutritional or financial service, and it does not replace any professional.
- The goals in the Guide and the Library are general examples, not advice for your family. You decide which to use, how to adapt them and who to assign them to, and you are responsible for those decisions.
- Whoever creates the family must be at least 18 and is responsible for the family. Only a child's parent or legal guardian may invite them, and accepts these terms on their behalf.
- The app is provided "as is". To the extent the law allows, we are not liable for damages that may result from using it or from following its ideas.
- Points, badges, crowns and the other rewards in the game have no monetary value.
- Disagreements are resolved by talking first and, failing that, by individual arbitration, not class actions. You can opt out of arbitration within 30 days of accepting.
1. Who we are and what you accept
Smart Fams is a product of We Sync Global, LLC ("we", "us"), a California limited liability company, United States. By creating a family, creating your profile, joining a family with an invitation, or simply using the app or this website, you accept these Terms of Use and our Privacy Policy, which is part of them. If you are a child, your parent or legal guardian accepts them for you when creating your invitation (§2). If you do not agree with something, do not use the app. Inside the app we ask you to confirm this by ticking a box; if we ever change these terms in an important way, we will show them to you again so you can accept them.
Today we offer the app in the United States, including Puerto Rico. If you use it from elsewhere, you do so on your own initiative; the non-waivable consumer protections of your country still apply, and some parts of these terms may not apply there.
2. Who can use Smart Fams
- A family is created by an adult (18 or older, or the age of majority in their country if higher), who becomes its leader. By doing so they declare that they are responsible for that family and accept these terms on their own behalf.
- Other adults accept these terms when they create their profile.
- A child joins the family only through an invitation from their parent or legal guardian. By creating that invitation, the parent or legal guardian declares that they are the child's parent or legal guardian, accepts these terms on the child's behalf and gives the consent described in the Privacy Policy (§4). If you are not the child's parent or legal guardian, ask the person who is to create the invitation.
- Children use the app under the supervision of the adults in their family, who are responsible for what a child does in it and for the goals and activities assigned to them.
- If you are a child reading this: ask an adult in your family before using the app.
3. What Smart Fams is (and what it is not)
Smart Fams helps a family write SMART goals, plan activities, track progress and celebrate it with a game of points, streaks, a league, a garden and postcards. It is an organization and motivation tool. It is not, and does not claim to be:
- a medical, psychological, therapeutic, nutritional, sports, educational, legal or financial service;
- a medical device or a tool for diagnosing, treating or monitoring health;
- a surveillance, parental-control or safety system;
- a substitute for the judgment of the adults in the family or of a qualified professional.
The app does not know your health, real age, physical condition, allergies, financial situation or personal circumstances, and it does not assess whether a goal is suitable for anyone.
4. The Guide, the Goal Library and "Inspired by science"
The Guide explains how the app works, the Library offers ready-written example goals, and the "Inspired by science" sheet describes the token-economy technique and links to third-party studies. All of that content is informational and general:
- The examples are written for any family, not for yours. They are not recommendations, prescriptions or personalized plans.
- Many goals touch on exercise, food, sleep, health, money or studying. Before creating, following or assigning a goal that could affect someone's health, safety or finances, and always when it involves a child, a pregnant person, or someone with an illness, an injury or a special condition, consult a qualified professional (doctor, pediatrician, nutritionist, coach, financial advisor…).
- The linked studies are published by third parties. We do not control them, we do not guarantee their accuracy or currency, and linking to them does not mean we endorse everything they say. We review them periodically, but they can change or disappear.
- The token economy and the other ideas we describe are general techniques, not a treatment or a program designed for your family.
You freely decide which goals to create, follow, adapt or assign to others, and you assume the consequences of those decisions. If a goal hurts you, stresses you or does not fit, change it or drop it: the app is designed so you can always start again.
5. Your responsible use
- Use the app with common sense. Do not use it while driving or during activities that need your full attention, and do not use it for emergencies: it is not designed for that.
- The adults in the family decide and supervise the goals, activities, permissions and agreements of the children, and are responsible for making sure they suit their age and circumstances.
- Look after your PIN and your email. Whatever is recorded from your profile is treated as done by you.
- Do not use the app for anything illegal, harmful or damaging to others; do not try to access other families, bypass the app's limits, extract the Library to resell it, or interfere with the service.
- If we detect use that breaches these terms, we may suspend or close the family involved.
6. Points, badges and gift code
Points, XP, levels, badges, crowns, avatar pieces, streaks and the other elements of the game have no monetary value, cannot be exchanged for money or transferred, and we may adjust, rebalance or remove them to keep the game fair. Each family's gift code entitles you to the discount in force when the subscription exists, under the conditions we publish then.
7. Price and subscription
Today Smart Fams is offered free of charge while in testing. When a subscription exists, it will be purchased and billed through the relevant app store (for example, Apple's App Store) or, if it were ever sold outside the store, through a provider acting as merchant of record; we will never charge your card ourselves. Price, renewal, cancellation and refunds will be governed by that store's or provider's conditions. We will tell you before charging anything, and we may change prices and free features with at least 30 days' notice inside the app.
8. Your content and our intellectual property
What your family writes in the app (goals, activities, notes, postcards, names) is yours. You give us a limited, non-exclusive, worldwide license to store it, sync it between your devices, display it inside the app, email it to the adults in your family who ask for it and, when your family shares the Postcard image, display it in that image to whoever receives the link, only to run the service and as described in the Privacy Policy.
Other people's copyright. Do not write into the app text that is not yours or that you have no permission to use. If you believe something written in Smart Fams infringes your copyright, write to support@smartfams.com with: which work is yours; which content infringes it and where it is (for example, the Postcard link); your name, address and email; a statement that you believe in good faith that the use is not authorized; a statement, under penalty of perjury, that what you say is accurate and that you are the owner or act on the owner's behalf; and your signature, written or electronic. We remove or stop displaying the content pointed out and tell the family, who may reply to us if they believe it does not infringe. If a family receives well-founded notices more than once, we close the family as section 13 explains.
The app, its code, design, texts, trademarks, the Goal Library and the rest of the content we create are ours or our licensors'. We give you a personal, limited, non-exclusive, non-transferable and revocable license to use the app within your family. You may not copy, modify, sell or reverse-engineer it, or use its content outside of it, except as the law expressly allows.
9. Availability and changes to the app
The app is provided "as is" and "as available". We may change, add, pause or withdraw features at any time, and interruptions, errors or data loss may occur. Keep copies of what matters to you (the app lets you export) and do not rely on it for anything critical.
10. No warranties
To the extent the law allows, we give no warranty, express or implied, about the app or its content, including warranties of merchantability, fitness for a particular purpose, accuracy, availability or freedom from errors. In particular, we do not guarantee that any goal will be achieved, or that using the app will improve anyone's health, habits, school performance, family relationships or finances; nor that the Guide, the Library or the linked studies are accurate, complete or suitable for your situation.
11. Limit of our liability
To the extent the law allows, neither We Sync Global, LLC nor its members, managers, employees, contributors or suppliers will be liable for indirect, incidental, special, consequential or punitive damages, or for injury, data loss, lost profits or lost opportunities, arising from or related to:
- using the app or being unable to use it;
- following, adapting, assigning or abandoning any goal, activity, example or idea from the Guide, the Library, "Inspired by science" or any other content in the app;
- decisions made by you or by another member of your family using information from the app or from the linked studies;
- what other members of your family do inside the app;
- failures, interruptions or changes by third parties we depend on (app stores, hosting, database, email);
- loss, corruption or unauthorized access to data, despite our security measures.
If, despite the above, we had any liability, the total we could owe you for all claims together will not exceed the greater of these amounts: what you paid for the app in the twelve months before the claim, or 50 US dollars.
Nothing in this section excludes or limits what the law does not allow to be excluded or limited: for example, liability for fraud, willful misconduct or gross negligence, for death or personal injury caused by our negligence where the law so provides, or the non-waivable rights you have as a consumer where you live. In those cases, these limitations apply to the maximum extent the law allows.
12. Your commitment to hold us harmless
If someone brings a claim against us because of something you did in breach of these terms or by misusing the app (for example, entering another family, or assigning a child an unsuitable goal without the supervision these terms require), you agree to answer for that claim and for the reasonable costs it causes us, to the extent the law allows.
13. Stopping use and closing the family
You can stop using the app whenever you want and ask for your data to be deleted as the Privacy Policy explains. We may suspend or close a family if it breaches these terms or if we stop offering the service, with reasonable notice when possible. And if no device in the family opens the app for 12 months, we email the adults with a verified address and delete the family 30 days later, unless someone opens it again first (Privacy Policy, §6). Sections 4, 6, 8, 10, 11, 12, 15 and 17 remain in force afterwards.
14. Changes to these terms
If we change these terms, we will update the version and date above. If the change is important, we will show it to you inside the app and ask you to accept it again before you continue using it. Earlier versions can be requested by email.
15. Governing law, arbitration and how to resolve a disagreement
These terms are governed by the laws of the State of California, United States, without its conflict-of-laws rules, and this section is also governed by the United States Federal Arbitration Act. If you live somewhere whose laws give you consumer protections that cannot be waived, those protections remain.
a) First, talk
If you have a problem, write to us at support@smartfams.com with your name, the email or profile you use in the app, what happened and what you are asking for. We will do the same with you if the problem is ours. Almost everything gets sorted out by talking, and we both commit to trying in good faith for 30 days from that notice before starting an arbitration or a lawsuit. Each person sends their own notice: a notice sent by a lawyer on behalf of many people at once does not satisfy this step.
b) Then, individual arbitration
If there is no agreement within 30 days, any disagreement between you and us related to the
app, the website or these terms (including their validity and scope) will be resolved by
binding, individual arbitration, and not before a judge or a jury. The
arbitration is administered by the American Arbitration Association (AAA) under its Consumer
Arbitration Rules in force and, where applicable, its supplementary rules for mass
arbitrations, available at www.adr.org. The arbitrator can award, on an individual
basis, the same relief a court could, and the decision can be enforced in any court with
jurisdiction. If an adult accepts these terms on behalf of a child, this section also covers
claims brought on that child's behalf, to the extent the law allows.
c) What stays in court
- Either of us may bring an individual claim in the small claims court with jurisdiction, if it falls within its limits.
- A request for public injunctive relief under California law: nothing in these terms prevents you from asking a court for it.
- Urgent relief to protect intellectual property or to stop unauthorized access, which either of us may ask a court for.
Whatever does not go to arbitration will be brought before the state or federal courts of Los Angeles County, California, unless the law where you live allows you to go to the courts of your own country.
d) Individually only
You and we agree that each claim is brought and resolved one at a time. Neither of us may act as a plaintiff or as a member of a class, collective, consolidated or representative action, and the arbitrator may not join the claims of different people or award relief that reaches other users, except as stated in c) about public injunctive relief. If a court decides that this waiver does not hold for a particular claim, that claim will go to court (not arbitration) and the rest of this section still applies.
e) Costs and place
We pay the AAA fees and the arbitrator's compensation, except the initial filing fee the consumer rules assign to the person claiming; if your claim succeeds, we reimburse it. Each of us pays our own lawyers, unless the law or the rules provide otherwise; we will not ask you to pay ours unless the arbitrator finds your claim frivolous. The arbitration takes place in the county where you live, by video call or in writing, as you prefer, and you may take part in Spanish or in English.
f) You can opt out of arbitration
If you prefer not to arbitrate, write to support@smartfams.com with the subject "Arbitration opt-out", your name and the email or profile you accepted with, within 30 days after the first time you accept these terms (or the first time you accept a new version of this section). Opting out changes nothing else: you can keep using the app, and disagreements will go to the courts in c).
g) Many similar claims
If 25 or more people bring similar claims with the same lawyers or in a coordinated way, they will be handled in batches of up to 50, each batch before a single arbitrator and with the fees of a single case per batch; the rest wait their turn, and, once the first batch is resolved, we will both sit down to mediate for 60 days before continuing. Limitation periods are paused while a claim waits.
h) Who decides what
The arbitrator decides the interpretation, scope and validity of this section and of these terms, with one exception: whether the class-action waiver in d) holds is for a court to decide.
i) Changes to this section
If we change this section, the change does not apply to disagreements you have already told us about, and you may reject it by writing to us within 30 days: the previous version will then continue to apply to you.
16. If you use the iPhone app (App Store)
When you download Smart Fams from the App Store, the software license is additionally governed by Apple's standard Licensed Application End User License Agreement, which these terms supplement. Apple is not a party to these terms, has no obligation to maintain or support the app, and is not responsible for any claim related to it (including product, consumer or intellectual-property claims): that is on us. Apple and its subsidiaries are third-party beneficiaries of these terms with respect to the iPhone app and may enforce them against you. You represent that you are not located in a country subject to a US embargo or on any US Government list of prohibited parties.
17. Other things
These terms and the Privacy Policy are the entire agreement between you and us about the app. If one part turns out to be invalid, the rest stands. Our not enforcing a right does not mean we waive it. You may not assign this agreement; we may assign it to whoever continues the service, with notice to you.
These terms exist in Spanish and in English and say the same. The English version controls their interpretation, as it is the one California courts and arbitrators read; but we will never rely on a difference between the two versions to your detriment.
